The troubles on Amazon and Flipkart are not seeming to stop. Both these e-commerce companies are going to be in trouble once again. The Competition Commission of India (CCI) has filed a petition against both of them in the country's highest court, the Supreme Court. Both these companies have been accused of anti-competitive practices. Last week, CCI has filed a transfer petition in the Supreme Court against these two companies so that the alleged unfair practices done by these companies can be stopped.

According to the report, some legal experts said that this case is expected to resolve the questions related to two key powers of CCI, one related to its search and seizure powers and the other related to the scope of investigation of CCI Director General (DG). Pertains to the power to broaden. Any adverse outcome from this case could further delay the CCI investigation and also set a precedent for other cases.

Appeal in Supreme Court

According to the affidavit filed in the court on December 3, CCI has appealed to transfer the cases filed in 24 different High Courts of the country in such cases to the Supreme Court. These include cases going on in Delhi, Karnataka and Telangana High Court. At present, the Supreme Court has not setup any bench for this case.

The first investigation by CCI has been stayed due to the writ petition filed by e-commerce companies Amazon and Flipkart. These cases of unfair practice on e-commerce companies are pending since 2020. CCI has expressed its views in the affidavit filed in the Supreme Court and said that the present case has already been delayed for 4 years and the final order is still awaited.

What is the matter?

CCI started investigating anti-competitive practices against these two e-commerce companies and other affiliate parties in January 2020. The Competition Commission of India says that e-commerce companies give preference to selected sellers who are in close contact with these platforms. A lobby of small traders led by the Delhi Trade Federation had filed a complaint against the e-commerce companies with the Competition Commission of India.
